Kanye West Is Being Sued
For using an uncleared sample. Uh-oh!
Uh-oh! The wonderfully-named Robert Poindexter has filed a lawsuit against Kanye West. Poindexter claims that Yeezy's remix of Jay-Z's 'Girls Girls Girls', which appeared on the mixtape Freshmen Adjustment 2, contains an illegal sample of 'Trying Girls Out' by The Persuaders, a 70s R&B band. The suit claims that Kanye knew the sample wasn't cleared for use, because he then used a cleared version of the sample on the version of 'Girls Girls Girls' that appeared on Jay-Z's The Blueprint album in 2001.

Despite the fact that Kanye's mixtape never saw an official commercial release, Poindexter claims that Yeezy "willfully infringed the copyright for private and financial gain by selling and distributing an untold amount of physical and digital copies." Poindexter also told AllHiphop.com, "I have offered to resolve this matter out of court with Kanye West. But in response, he has refused to even discuss any 'out-of-court' resolutions whatsoever. Nor has he provided any evidence that he is demanding others to cease and desist from selling the illegal version." Robert Poindexter seeks $500,000 in damages from Yeezy (a mere pittance compared to the $50 million being demanded of Alexander Wang).
